Consent, Waiver of Liability, Assumption of Risk, and Release

FarWell Wood-Fired Sauna
Operated by Soaring Horizon Capital LLC (“FarWell”)

1. Assumption of Risk

I understand that use of a wood-fired sauna and related facilities involves inherent risks, including but not limited to:

  • Heat-related illness, dehydration, dizziness, fainting

  • Cardiovascular strain or complications

  • Slips, falls, or environmental hazards (including wet, uneven, or icy surfaces)

  • Risks associated with hot surfaces, steam, and water

  • Risks associated with cold water exposure

I understand that these risks may arise from:

  • My own actions or inactions

  • The actions of others

  • Environmental conditions

  • The condition or operation of the sauna and surrounding area

I voluntarily and knowingly assume all such risks.

2. Health Representation

I represent that:

  • I am physically and medically able to participate

  • I have not been advised against sauna or heat exposure by a medical professional

  • I will not participate while ill, impaired, or under the influence of drugs or alcohol

I accept full responsibility for monitoring my physical condition.

3. Release of Liability

To the fullest extent permitted by the laws of the State of Illinois, I hereby release, waive, and discharge FarWell, Soaring Horizon Capital LLC, and their owners, officers, employees, contractors, and agents from any and all claims, liabilities, damages, or causes of action arising out of or related to my use of the sauna and related facilities, including those arising from alleged negligence.

This release does not apply to conduct that constitutes gross negligence or willful misconduct where such limitation is prohibited by law.

4. Indemnification

I agree to indemnify and hold harmless FarWell from any claims, damages, costs, or expenses (including attorneys’ fees) arising from my participation or my violation of any rules or policies.

5. Rules and Compliance

I agree to follow all posted rules and staff instructions, including but not limited to:

  • No use under the influence of drugs or alcohol

  • No use while ill

  • Proper attire required

  • No metal objects that may cause burns

  • No misuse of sauna equipment

FarWell reserves the right to refuse service to anyone for safety reasons.

6. Minors

Participants under 18 must be accompanied by a parent or legal guardian, who must sign this agreement on their behalf and assumes full responsibility for the minor.

7. Personal Property

I understand that FarWell is not responsible for lost, stolen, or damaged personal property.

8. Photography & Commercial Use

Personal, non-commercial photography is permitted. Any commercial or promotional use of images or video requires prior written consent from FarWell.

9. Cancellation Policy

I acknowledge and agree to FarWell’s cancellation and rescheduling policies as presented at the time of booking.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois.

11. Severability

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12. Term

This Agreement applies to all visits within a period of one (1) year from the date of acceptance unless revoked in writing.

13. Acknowledgment

By signing or agreeing electronically, I acknowledge that:

  • I have read and understand this Agreement

  • I am voluntarily giving up certain legal rights

  • I agree to be bound by its terms
